Seller Applicants should send documents requested as part of the Seller verification process to:
The email should be sent from the email address used for the Seller application and should state the applicant’s full name or registered business name.
Seller Applicants should send only the documents requested by Hoskay and should conceal information that is not necessary for the verification process.
3. NATURE OF THE PLATFORM
Hoskay operates an online marketplace through which independent Sellers may offer Products to Buyers.
Unless Hoskay is expressly identified as the Seller on the relevant Product Page, Hoskay is not the seller, manufacturer, importer, distributor or owner of the Product.
The identity and business status of the relevant Seller will be displayed on the Product Page, during checkout, in the Order information or in the Order confirmation.
Where a Product is offered by an independent Seller, the sales contract is concluded directly between the Buyer and that Seller.
The relevant Seller is responsible for:

the Product description and price;

Product availability;
-
the legality, safety and conformity of the Product;

accepting and fulfilling Orders;

packaging and dispatch;

delivery;
-
invoices and legally required documents;

cancellations and returns;

complaints and statutory guarantees.
Hoskay provides the technical marketplace environment and may facilitate communications, payments, refunds and dispute resolution without becoming the Seller or a party to the sales contract.
4. PLATFORM TECHNOLOGY
The Platform is hosted or technically supported by Shopify.
Hoskay may also use Webkul and other third-party technology providers for marketplace functions, including:

Seller dashboards;

Product listings;
-
Order allocation;
-
payments and payouts;
-
communications;
-
analytics and security.
Shopify, Webkul and other providers operate in accordance with their own applicable terms and privacy documentation.
5. INTELLECTUAL PROPERTY
The Hoskay name, logo, branding, Platform design and original content created or owned by Hoskay are protected by applicable intellectual property laws.
Product images, descriptions, trademarks and other materials displayed on the Platform may be owned by the relevant Seller, manufacturer or another rights holder.
No part of the Platform may be reproduced, commercially used, distributed or modified without the prior permission of the relevant rights holder, except where permitted by law.
The display of third-party trademarks or materials does not imply ownership or endorsement by Hoskay.
6. ACCURACY OF INFORMATION
Hoskay aims to maintain accurate and current information about the Platform.
Product descriptions, prices, availability, delivery information and Seller details are generally provided by the relevant independent Seller.
The Seller is responsible for ensuring that the information it provides is accurate, complete, lawful and not misleading.
Hoskay may correct, restrict or remove information or listings where there are reasonable grounds to believe that they are inaccurate, unlawful, unsafe or contrary to Platform rules.
7. EXTERNAL LINKS
The Platform may contain links to websites or services operated by independent third parties.
Hoskay does not control and is not responsible for the content, availability, security or privacy practices of independent third-party websites.
The inclusion of a link does not necessarily constitute approval or endorsement of the linked website, service or operator.
Users should review the terms and privacy policies of third-party services before using them.
8. LIABILITY
Nothing in this Legal Notice excludes or limits liability that cannot lawfully be excluded or limited.
Hoskay remains responsible for obligations that it directly undertakes as operator of the Platform.
Where an independent Seller is identified as the seller of a Product, that Seller remains responsible for the sales contract and the Product, including its:

quality;

legality;

safety;
-
conformity;
-
packaging;
-
dispatch;
-
delivery;
-
returns;
-
statutory guarantees.
To the extent permitted by law, Hoskay is not responsible for losses caused solely by an independent Seller, courier or third-party service provider outside Hoskay’s reasonable control.
This provision does not restrict mandatory Consumer rights or any responsibility imposed on Hoskay by applicable law.
9. REPORTING ILLEGAL OR UNSAFE CONTENT
Products, listings or content believed to be illegal, unsafe, counterfeit, misleading or otherwise non-compliant may be reported to:

Hoskay may investigate a report and take appropriate action, including restricting or removing a listing, requesting information from a Seller, suspending an account or notifying a competent authority.
10. CONSUMER COMPLAINTS
Complaints concerning a specific Product, delivery, withdrawal, return, refund, lack of conformity or statutory guarantee should first be directed to the relevant Seller.
The Seller’s contact information will be available through the Product Page, Seller profile, Order details or Order confirmation.
Hoskay may assist with communication between a Buyer and Seller.
For technical problems with the Platform or where a Seller cannot be contacted, Buyers may contact:
Consumers may also contact the Bulgarian Commission for Consumer Protection or another competent consumer protection or alternative dispute resolution body.
11. PERSONAL DATA
Personal data is processed in accordance with the Hoskay Privacy Policy and Cookie Policy.

12. APPLICABLE LAW
This Legal Notice and the operation of the Platform are governed by the laws of the Republic of Bulgaria.
Nothing in this Legal Notice deprives a Consumer of mandatory protections available under applicable law.
Disputes will be considered by the competent courts determined under applicable law.
